Introduction
This Consumer Health Privacy Notice (“Notice”) outlines how Arii LLC (“Arii”, “We”, “Us”, or “Our”), including Arii’s affiliates, processes personal health information (“PHI”) in accordance with the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable state laws, (collectively, “Healthcare Laws”). This Notice supplements Our Privacy Policy and takes precedence in case of conflicts regarding PHI. Capitalized terms not defined in this Notice will have the meaning stated in Our Terms of Service (“Terms”) and applicable Healthcare Laws. By accessing Our App (as defined below), the person using the App (“You”) agree to the terms of this Notice and the accompanying Terms.
Scope
This Notice applies to the collection, use, and protection of Your Consumer Health Data obtained through Our Arii mobile application (“App”).
Collection of Health Information
We may collect Your PHI and other health-related information (“Consumer Health Data”) from various sources and in different ways, depending on how You use the App and what You choose to share with Us, including:
- Direct Provision. Information You provide when using the App, such as PHI, health data, contact details, demographic information, and government-issued identifiers.
- Automatic Collection. Data collected through device usage, online activity, technical tracking technologies, and linked devices such as fitness trackers.
- Third-Party Sources. Data obtained from partners, social media, and third party services and devices like Apple HealthKit that You connect to the App.
Types of Health Information We Collect
We collect a comprehensive range of health information, including:
- Health Data. Health and wellness-related data, such as information concerning Your past, present, and future physical and/or mental health status and goals, medical conditions, symptoms, medications, diagnoses, treatment data, claims and health insurance data, and any other information that You voluntarily provide via the App, including in response to prompts and other questions through the App.
- Relationship data. Such as familial or other relationships to third parties whose personal information You may provide to Us.
- Sensitive Data. Characteristics of protected classifications, such as if You choose to provide in Your user-generated content data related to, for example, Your age, race or ethnic origin, health, sexual orientation, or other similar information.
- Generated Health Data. Information generated based on Your inputs, such as likely causes for symptoms, risk status, treatment eligibility, and output related to Your healthcare data.
- User-Generated Content. Photographs, videos, documents, diagnostic test results, and other health-related content You upload, along with associated metadata.
- Biometric Data. Fingerprints, iris scans, facial images, and other biometric identifiers.
- Activity and Device Data. Data shared or linked from Your devices or other third party services like fitness trackers, health apps, and digital trackers (e.g., smart scales, glucose devices).
- Communication and Profile Data. Contact details such as Your name, email, phone number, and physical addresses, profile information including username, account details, and social media links, and communications data from interactions with You via email, social media, or Our customer support channels.
- Sensory Data. Such as audio and video recordings or similar information.
Use of Health Information
We use Your Health Information for:
- Service Delivery and Operations. Providing and improving Our App, establishing and maintaining Your user profile, enabling security features, and communicating service-related updates.
- Personalization. Understanding Your needs and interests, tailoring user experiences, and remembering preferences as You navigate our App.
- Research and Development. Analyzing and enhancing Our App, developing new products, and conducting research to improve user experience.
- Direct Marketing. Informing You about new services, events, and updates, and engaging with You through marketing communications.
- Compliance and Protection. Meeting legal obligations, protecting rights and property, and preventing fraudulent or unauthorized activities.
- Creating De-identified Data. Using aggregated, de-identified, or anonymized data for lawful business purposes, including analysis and service improvement.
Sharing of Consumer Health Data
We may share Your Consumer Health Data with:
- Designated Third Parties. As directed or consented by You, including healthcare providers, administrators, and third party applications You connect to the App.
- Legal and Law Enforcement Entities. To comply with legal requests, subpoenas, or government investigations, and to protect the rights and safety of individuals.
- Service Providers and Affiliates. Third-party processors and Our affiliates operating under strict data processing agreements to assist with service delivery and operations.
User Rights
Depending on Your state of residence, You may have rights under applicable laws, including:
- Access and Confirmation. Request copies of Your Consumer Health Data and confirm its collection or sharing status.
- Correction. Request corrections to inaccuracies in Your Consumer Health Data.
- Deletion. Request deletion of Your Consumer Health Data, subject to certain limitations and legal requirements.
- Withdrawal of Consent. Withdraw consent for future data collection or sharing.
- Appeal. Appeal denied rights requests, with details provided on how to proceed with such appeals.
