This Privacy Policy (“Privacy Policy”) applies to the Arii mobile application (“App”), owned and operated by Arii LLC (“Arii”, “We”, “Us”, or “Our”). We act as a data controller (or applicable equivalent) and are responsible for the handling of Your personal information. We have created this Privacy Policy to tell you (“You”) what information the App collects, how We use that information, and who We will share that information with, if at all. This Privacy Policy does not address the privacy practices of any third parties that We do not own, control, or are affiliated with. Capitalized terms not defined in this Privacy Policy will have the meaning stated in our Terms of Service (“Terms”). By accessing Our App, You are agreeing to the terms of this Privacy Policy and the Terms.

We encourage You to read the Privacy Policy, and to use the information it contains to help You make informed decisions.

Information We Collect or Receive

In the course of You using the App or communicating with Us, We will collect and/or receive the following types of information. You authorize Us to collect and/or receive such information.

Personal Information

We only receive or collect information that identifies You personally if You choose to provide such personally identifiable information to Us electronically or via other means. When You sign up to become a User or contact Us, You will be required to provide Us with personal information about Yourself (“Personal Information”). Such Personal Information may include Your name, email address, physical address, date of birth, and phone number. We do not collect any Personal Information from You when You Use the App unless You provide Us with the Personal Information voluntarily.

 

Third-party Log In and Services

Where applicable, if You sign-in via a third-party account or connect the App to third party services, You are authorizing Us to collect, store, and Use, in accordance with this Privacy Policy, any and all information that You agreed that the third-party account would provide to Us through its application programming interface (“API”). Such information may include, without limitation, information You share with Us from Your third party service provider, Your first and last name, the third-party Username or email, profile picture, headline, unique identifier and access token, and email address.

 

Payment Information

If You choose to make a purchase or subscribe to a feature or service that requires a fee, You will be required to provide Us with Your payment Information, including, without limitation, credit card or debit card numbers, account details, and similar data (“Payment Information”). Such Payment Information will be collected and processed by our third-party payment vendor under the terms and conditions of their privacy policy and applicable terms of use, and We do not obtain access to any Payment Information in connection with such purchases or subscriptions.

 

Geolocational Information

Certain features and functionalities of the App are based on Your location. In order to provide these features and functionalities while You are using Your mobile device, We may collect Geolocational Information from Your mobile device or wireless carrier and/or certain third-party service providers (collectively, “Geolocational Information”) with Your consent. Collection of such Geolocational Information occurs according to the selection You make on your device. You may decline to allow Us to collect such Geolocational Information, in which case We may not be able to provide certain features or functionalities to You.

 

Third-Party Analytics

We and Our third-party technology providers We use may use third-party analytics services (e.g., Sentry) to evaluate Your use of the App, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the App and mobile and internet usage. By using the App, You consent to the processing of data about You by these analytics providers in the manner and for the purposes set out in this Privacy Policy.

 

Health Information

We may collect health data, including nutritional, exercise, sleep, therapy, lifestyle, body metrics, medication, supplements, personal health information, and other health and fitness related information (“Health Information”) You choose to submit to the App.

 

Other Information

We may automatically collect or receive additional information regarding You and Your use of the App, Your interactions with Us, and information regarding Your tablet or mobile device used to access the App (“Other Information”). Such Other Information may include:

– Additional information about Yourself that You voluntarily provide to Us, such as Your gender, account details, and App preferences;
– We may collect or receive information regarding:
– IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable tablet or mobile device;
– Browser type and language;
– Referring and exit pages and URLs;
– Date and time; and
– Details regarding Your activity on the App, such as search queries and other performance and usage data.
– We may collect or receive information regarding:
– Type of mobile device;
– Operating system and version (e.g., iOS);
– Carrier; and
– Network type (Wi-Fi, 3G, 4G, LTE).
– We may use both session cookies, which expire once You close the App, and persistent cookies, which stay on Your mobile device or tablet until You delete them and other technologies that help Us collect data to enhance Your experience with the App. Cookies are small text files the App uses to recognize a repeat visitor. We may use cookies for various purposes, including to:
– Identify Your type of mobile device or tablet;
– Personalize Your experience; and
– Analyze which portions of the App are visited and Used most frequently.

 

Functionality

If You do not want Us to deploy cookies in the App, You can opt out by setting Your mobile device or tablet to reject cookies. You can still Use the App if You choose to disable cookies, although Your ability to use some of the App’s features may be affected. We will otherwise indicate to You where the provision of certain Information is required for Us to provide You with certain services in the App, such as Your account credentials and user log-in information.

 

Legal Basis

Our legal basis for processing Your Personal Information is based off of Your consent and Your agreement to Our Terms of Service and this Privacy Policy.

 

How Information is Used and Shared

You authorize Us to use the information we collect or receive (as described above, collectively, the “Information”) to:

– Provide and improve Our App;
– Administer Our promotional programs;
– Solicit Your feedback; and
– Inform You about Our products and services.

 

Third-Party Services

We may engage third-party companies and individuals to perform functions on Our behalf. Examples may include providing technical assistance, subcontracting the Services, customer service, marketing assistance, and administration of promotional programs. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law. We have ensured that any third-party company that we utilize in connection with the App is under obligations at least as stringent as the obligations described in the Privacy Policy, including obligations relating to protecting your Personal Information. We remain responsible for all such third-party companies as it relates to Your Personal Information’s protection under this Privacy Policy. The current list of third-party companies we use to provide the services is listed in Annex I below.

 

Third-Party Integrations

If You choose to integrate third-party applications (e.g., Apple HealthKit, FitBit, Your healthcare providers through Apple, etc.) and devices with the App, We may share certain integration information with these third parties, including username, device information and any other Information provided or consented to by You.

 

Analytics

In an ongoing effort to better understand Our users, We may analyze App usage data in anonymized and aggregate form to operate, maintain, manage, and improve the App. This aggregate information does not identify You personally. We may share and/or license this aggregate data to Our affiliates, agents, business and promotional partners, and other third parties. We may also disclose aggregated user statistics to describe the App and these products and services to current and prospective business partners and investors and to other third parties for other lawful purposes. By using the App, You consent to the foregoing.

 

Affiliated Companies

We may share some or all of Your Information with any of our parent companies, subsidiaries, joint ventures, or other companies under common control with Us.

 

Sale or Purchase

As We develop our business, We might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, Your Information may be part of the transferred assets.

 

Applicable Law

To the extent permitted by law, We may also disclose Your Information:

– When required by law, court order, or other government or law enforcement authority or regulatory agency; or
– Whenever We believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of Us or others, including You.

 

No Selling of Your Data

We will not sell Your Personal Information for any monetary value and will only share Your Personal Information as described in this Privacy Policy. Because of the broad definition of “sale” under applicable data privacy regulations, however, We may disclose Your Personal Information with certain vendors and affiliates to provide services on Our behalf or in the context of a business transfer.

 

Accessing and Modifying Information and Communication Preferences

If You have provided Us any Personal Information, You may access, remove, review, and/or make changes to the same by contacting Us as set forth below. In addition, You may manage Your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing emails. We will process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in Our subscription databases. You cannot opt out of receiving transactional emails related to the App (e.g., requests for support). We may also deliver notifications to Your mobile or tablet device (e.g., push notifications). You can disable these notifications by deleting the relevant service or by changing the settings on Your mobile or tablet device.

 

For cookies, You can set your browser to refuse all or some browser cookies, or to alert You when cookies are being sent.

Subject to applicable law, Your rights include:

Right of access. You have the right to obtain access to Your Personal Information.
Right of portability. You have the right to receive a copy of the Personal Information You provided Us in a structured, commonly used, machine-readable format that supports re-use, or to request the transfer of Your Personal Information to another person or entity.
Right to rectification. You have the right to obtain rectification of any inaccurate or incomplete Personal Information We hold about You without undue delay.
Right to erasure. You have the right to require Us to erase your Personal Information without undue delay if the continued processing of that Personal Information is not justified.
Right to restriction. You have the right to require Us to limit the purposes for which We process your Personal Information if the continued processing of the Personal Information in this way is not justified, such as where the accuracy of the Personal Information is contested by You.
Right to object. You have a right to object to the processing We carry out on the basis of legitimate interests in certain circumstances. You can also object to Our direct marketing activities for any reason by clicking the “unsubscribe” link set out in any marketing communication or contacting Us using the details set out below.
Right to withdraw consent. If You have provided consent to any processing of Your Personal Information, including in relation to the processing of Your Health Information, You have a right to withdraw that consent.

How We Protect Your Information

We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which We may share such Information, nor can We guarantee that the Information You supply will not be intercepted while being transmitted over the Internet. In particular, email sent to Us may not be secure, and You should therefore take special care in deciding what information You send to Us via email.

 

Miscellaneous Provisions

Important Notices to Non-U.S. Residents

The App and its servers are operated in the United States. If You are located outside of the United States, please be aware that Your Information, including Your Personal Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of Your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in Your jurisdiction. If You are located outside the United States and choose to Use the App, You hereby irrevocably and unconditionally consent to such transfer, processing, and Use in the United States and elsewhere.

 

App Stores; External Websites

The applicable app store You used to download the App may collect certain Information and other usage-data in connection with Your use of the App. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies. The App may contain links to or content and services from third-party websites or providers. We have no control over the privacy practices or the content of these websites or services. As such, We are not responsible for the content or the privacy policies of those third-party websites or services. You should check the applicable third party’s privacy policy and governing terms and conditions when visiting any other websites or using any services not provided by Arii.

 

Children

The App is not directed to children under the age of 13. We will not knowingly collect Personal Information from any child under the age of 13. Minors under the age of 13 are prohibited from using the App. Any person who is 13 or older but under the applicable legal age of consent must obtain appropriate consent from their parent or guardian before using the App. If a child under the age of 13 has provided Us with Personal Information, a parent or guardian of that child may contact Us and request that such information be deleted from Our records by using the [email protected] email.

 

International Transfers

Depending on Your location and how You use the App, Your Personal Information may be transferred internationally. We ensure that all third-party vendors have contractual obligations to provide adequate security measures and protection of Your Personal Information and are compliant with applicable data privacy laws. We utilize the European Commission’s Standard Contractual Clauses (and the UK addendum where applicable) for all international transfers.

 

Information Retention

We retain information pursuant to the retention periods specified below, after which We will either delete or anonymize the information. If deletion is not possible (e.g., when the information is stored in Our standard backup and archives), We will securely store the information and isolate it from further use until deletion is triggered through Our retention policy.

Account information. We retain Your account information while Your account is active and for a reasonable time thereafter. Some information may be retained as necessary to comply with applicable law, resolve disputes, enforce agreements, support business operations, and to develop and improve the App.
Data Subject Requests. We retain Your identification, account, and contact information, and any data relating to your data subject request as long as necessary to comply with applicable law.
Marketing information. If You opted to receive marketing emails regarding Arii, We retain Your marketing preferences for a reasonable and compliant period after Your last indication of interest. We also retain information collected from cookies and other tracking technologies for a reasonable and compliant period after its collection.

 

Changes to This Privacy Policy

We may change this Privacy Policy from time to time. Any such changes will be posted on this page and will be accessible via the App. By accessing the App after We make any such changes to this Privacy Policy, You are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time We collect the Information. Please refer back to this Privacy Policy on a regular basis.
